25 states back New Hampshire against lawsuit looking to restore motor vehicle inspections

CONCORD, N.H.- A coalition of 25 prosecutors are backing New Hampshire against a federal lawsuit filed by Gordon-Darby Holdings that seeks to once again require the Granite State to inspect motor vehicles.

According to court documents, West Virgina Attorney General John McCuskey’s office recently filed a brief with the U.S. Circuit Court of Appeals in Boston.

The show of support comes after the same court recently reversed a lower federal court’s temporary injunction against New Hampshire for terminating it’s inspection program.

Following word of the additional support, New Hampshire’s Attorney General John Formella issued said: ” We appreciate the support of our fellow state attorney general, who submitted this amicus brief and who recognize the important constitutional and federalism issues involved in this case.

Gordon-Darby originally filed their suit after New Hampshire’s Legislature voted to do away with the mandate after citizens voted in favor of the move and claimed by doing so New Hampshire was violating rules set forth by the Environmental Protection Agency.
