Judge rules question on School Tax Cap can appear on November ballot

MANCHESTER, N.H.- A judge says questions about a school tax cap can appear on the November ballot.

On Wednesday Superior Court Judge Daniel St. Hilaire denied an emergency request to remove the question, ruling that plaintiffs the Kelly Wieser of Campton and David Bates of Warner failed to meet the requirements for a preliminary injunction.

In their lawsuit the pair had claimed that the question was confusing for voters and structured in a way that violates the state constitution.

The suit comes after lawmakers earlier this year passed legislation to put local property tax caps on ballots in every community in the state, both in the 2026 election and in 2028.

Supporters claim the question will allow a larger number of voters to have a say in local spending.
